Ini Udoka Vs Mike Akpan: Court Decries Delay By Lawyers... Decides case March 1 PDF Print E-mail

The Federal High Court sitting in Uyo has reserved judgment in a suit filed by the Peoples Democratic Party (PDP) aspirant for Ikono/Ini federal Constituency, Hon. Michael James Akpan against Independent Electoral Commission (INEC) till March 1, 2012.
Justice A. I Chikere fixed the date  for the judgment yesterday at a resumed hearing on the case. The learned justice noted with dismay that the case has dragged for too long due to unnecessary filing of motions and counter motions by the parties involved.
She also said since counsels to both the plaintiff and the defendants have addressed the court on the point of law, the court will do it best to give judgment on the case without further delay.
The Plaintiff, Chief Michael Akpan had approached the court in a suit No FHC/UY/CS/141/2011 praying it to declare him the authentic candidate of PDP in April last year election. He argued that the 3rd Respondent did not purchase the nomination form, thus ineligible to be sponsored by 2nd Respondent and allowed to stand for election by the 1st Respondent.
Chief Akpan who said he has his faith in the court to do justice, regretted that case has delayed too long.
He expressed optimism that the court will deliver its judgment without fear or favour and that his mandate would be given him.
Meanwhile, as part of the efforts by the court to establish the authentic candidate of the PDP for Ikono/Ini Federal Constituency, the court hand in November last year issued a supoena on the Chief Registrar of Abuja Federal Capital Territory High Court, Mrs. Toyin M. Yahaya, to appear before it to give evidence on behalf of the plaintiff and also bring with and produce the original Revenue Registers/Books of the Court for 20/10/2010 and 11/1/11 and the Revenue Receipts issued to Prof. Ini Akpan Udoka, the 3rd Respondent in the suit.
The Sensor learnt that the documents were to assist the court in the evident before it but the Chief Registrar only mandated Mr. Kayode Agunloye, head of legal unit to represent him.
It would be recalled that case has suffered several setbacks due to filing of motions and counter motions.

    It is true that the case has suffered a lot of setbacks but l have faith in court that justice wil only be done but seen to be done,as an indigene and public affairs analynist from lni, Udoka did not buy house of reps form but senate form so he has no in the house,therefore,his days are numbered, he wil soon pack his loads and leave that seat for a rightful owner Hon. Mike Akpan.Let Udoka point out a single project has done in his constituency for 5 years in office, also a second timer but chairs no committee a prof for that matter. He has not moved any motion nor contribute on the floor of the of the house.I stand to be corrected if there is any contrary views.publish this
